Losing Rat would destroy any chance they have of competing in the big12 this season. Santiago and his Whales won’t let it happen.
But what about the Honor code and the whole no sex before marriage thing????
The honor code for athletes doesn’t exist anymore at BYU. It’s not even a thing.
Jake will be the starting QB game 1 and this won’t even get a mention.
Count on it.

ParticipantI think part of her claim is that Provo PD suppressed the evidence. If they did, it will come out in discovery and they very well could be filing criminal charges in the future (Hopefully it’s all not true)

ParticipantYou answered your own question as far as the criminal aspect is concerned. No district attorney in the land would touch this. It would be very hard to prove beyond a reasonable doubt. To be fair, rape often is. He said she said cases are very difficult to convince a jury.

ParticipantI’m a believer that a legal adult accuser should be identified just as Retzlaff has. These type of allegations follow a man around for the rest of his life even when they are provably false. I also feel that if an allegation is proven false that the accuser should face the same punishment that the accused would have if he had done it. This would drastically cut down on the false accusations. There certainly could be some negative consequences like people not coming forward, but again, the standard would be if it could be proven the allegations were false or malicious, you would face the same consequences.
As far as this situation is concerned. The allegations are very troubling and we will see how this all shakes out.

Crazy. I get so tired of this. I almost want to require you to get a notary to sign with written consent before entering the bedroom. This would clear up the intentions. This girl drives from Salt Lake to Provo, has her friend leave the house, and leaves them alone as they enter the bedroom. There is some confusing communication happening. It is best to get the notary to sign off on the intentions.

ParticipantIf the accused is exonerated, then yeah, I could see naming the accuser. But to have to have your name attached to the accusation as the victim, when you have done nothing wrong, that would be terrible and prevent a lot of legitimate victims from coming forward.

ParticipantGoing to have to disagree with you. I think the name of the accuser and accused should be public. I think that’s the only way to be as fair as possible. You should put your name next to such an accusation because it’s so serious. As for BYU fans shaming her or anybody in that circumstance without the evidence, let them reveal themselves for what they truly are.
As for the rape kit, I think it’s likely going to show they had sex as the previous poster said, but hopefully we can find the evidence to determine whether it was consensual ot not.

ParticipantI am just pointing out that the article says he is accused of sexual assault, not rape. They are different. Not trying to argue. I guess rape charges could eventually be added but my guess is that will depend on the evidence.

So far Provo AG hasn’t filed charges for a criminal case (which could be rape), but you have to think they’re triple checking what the officer knew 18 months ago

Unfortunately, even if he’s proven innocent, he’ll often be thought of in conjunction with this situation instead of just for his football skills.

ParticipantTony I think the core of the problem is putting religious shame on women for having normal desires. Resulting in guilt and shame after the fact. No means no reguardless of religion or any other excuse. It’s a no win situation for everyone involved and Utah State has had the same issues in the past. Utah State got mocked for addressing the problem in a team meeting with police officer and coaches. This could have some backlash on recruiting non LDS players.

ParticipantIf BYU fans thought road crowds were bad last year they will be relentless this season if Rat plays.
BYU has been able to keep a lot of honor code violations private over the last few years that resulted in zero punishment for the offending players.
At the very least sex happened between Jake and the girl and it’s gone worldwide. Sitake and Santiago can’t hide this one.
This will be a fight between the AD and Honor code office. It will be a fun little side note to this story.
My guess. He gets suspended for their 3 games cakewalk non conference schedule.

ParticipantWhether guilty or innocent, Cougar fan’s response to the Retzlaf situation serves as a stark reminder to me that I genuinely do not enjoy being TDS’ conference rival or sharing space with that fan base. I would hang my head in shame if Ute fans behaved in the same manner should our starting QB ever be accused of the same things.
